800 lei each for voting for the political bloc 'Victory' in Florești during the parliamentary elections of 2024.

During the electoral period, at the beginning of October 2024, before the elections on 20.10.2024, Morari Iulia, acting as an executor on behalf of the political party “Victory”, allegedly offered and gave sums of money (800 lei each) to several voters (Dracenco Eudochia, Roman Constantin, and Petrov Emilia), with the aim of persuading them to exercise their right to vote in favor of the respective political formation. The actions were legally classified as electoral corruption (art. 181¹ para. (1) Criminal Code).

First court: Conviction

The court found that the guilt of the defendant was proven by a set of corroborated evidence (witness statements, search reports, and material evidence), which confirm the existence of actions of offering and giving money for the purpose of influencing the vote. The witness statements were considered credible and consistent, while the defendant's position – denying the facts – was critically assessed as an attempt to evade responsibility.

The court emphasized that the crime provided for in art. 181¹ para. (1) of the Penal Code is a formal one, completed by the mere offering or giving of money, without the need for acceptance by the voter or the actual production of a result. It also noted the existence of direct intent, manifested through the purpose of determining voters to exercise their voting rights in a certain direction.

In individualizing the punishment, the court took into account the less serious nature of the crime, the absence of criminal records, the personal situation of the defendant, and the absence of violence or a central role in an organized mechanism, considering that the application of a monetary fine is sufficient to achieve the purpose of the punishment.
